A Game With No Winner

Let the lawyer games begin. My blog “Square One”, of October 1, was unfortunately prophetic. The WPI is in fact using money donated by patients to pay lawyers to sue Dr. Mikovits. One more in a very long line of horrible decisions. I am truly incredulous. This entire fiasco is doing great harm to the patient community, the extent of which is unknowable at this time. The research is destroyed. The notebooks and specimens are potentially compromised.

As I finished that last paragraph, a friend sent me Annette Whittemore’s blog just posted. I really don’t know how she keeps a straight face. She’s suing her chief scientist and the principle investigator on the institute’s grants, after termination without cause, to obtain notebooks and flash drives that Dr. Mikovits apparently does not have, since she was locked out of her lab suddenly and unexpectedly. I would say that as the “the guardian of this property”, Mrs. Whittemore has failed pretty miserably. And now she is using a little of the millions of unaccounted for dollars to sue Dr. Mikovits. I thought I understood the depth of the incompetence, but it just keeps getting worse. She thinks the patient community is going to be OK with this? Business as usual? Wait for the WPI to figure out a cure, without a chief scientist, and oh, please send more money? Who is she kidding? Sorry Annette, now we have to think about a legal defense fund for Judy!

I was going to write some good news, to follow the bad news, but I think I’ll write that when I’m not feeling like I’ve been slimed.

It was also hard copy faxed from my fax line at my office at the same time to the lawyer. I personally witnessed this transaction. I am beyond outraged at the shameful accusations thinly veiled by Annette Whittemore in her letter today. Patients need to know that letter titled "Our Responsibility" is full of lies.

    I was also present at Dr. Mikovits home on Friday, November 30 at approximately 11:30 am moments after she returned from Reno, having driven all night. I personally saw the empty rental car driven by Dr. Mikovits from Reno to California that did not contain any of the materials alleged in the the letter from Annette Whittemore. The allegations in her letter are astonishing to me. Dr. Mikovits was fired by phone while she was standing on the sidewalk outside her Reno home. She never returned to the WPI. The firing took place at approximately 4:30pm and the lab was locked down by approximately 6:30 pm. Due to the activity of moving out of the Reno home, Dr. Mikovits had no opportunity to return to the WPI at any time. There are ample dated, time stamped receipts documenting and proving her whereabouts from the time of the firing to the time of her arrival in California. At no time did she ever return to the WPI facility. It is impossible for her to have stolen the items alleged in the "Our Responsibility" letter.

    I am prepared to testify in court to the events I personally witnessed. Patients need to know that Dr. Mikovits remains fully committed to the well being of the patients. She has always conducted herself with the utmost of integrity. Patients need to ask themselves who had the motive to remove and destroy the notebooks. Who had a motive to remove incriminating evidence? Who stood to lose with the revelation of misappropriation of funds and materials? It was not Dr. Mikovits.

    Dear Mr. Matthews,

    My client, Judy Mikovits, and I have reviewed the demand letter your office delivered to her via email and FEDEX, November 3rd.

    This is written in response to your statements made in this letter on behalf of your client. All of the allegations of theft, misappropriations, withholding of data and various intellectual property, and items, are incorrect, and untruthful.

    Your client’s allegations that Dr Judy Mikovits has wrongfully taken and retained laboratory notebooks and other intellectual property owned by the Whittemore Peterson Institute, are not true.

    Dr. Mikovits routinely locked the lab notebooks in a drawer in her desk, whenever she left the lab, as they contain confidential patient information. The keys to her desk were always in a placed in a convenient location easily accessible for her lab assistants. Dr. Mikovits habit was to leave them either in the lab, in one of the unlocked drawers under the lab benches that are underneath the lab windows. Otherwise, the keys were in the unlocked top drawer of her desk. Dr. Mikovits’ assistants always have access to their lab books and anything else they needed at any time.

    Dr. Mikovits had worked for several days, including the prior weekend, outside of the country, presenting talks and representing WPI at meetings and conferences. She worked through the week until Thursday, September 29, 2011. Dr. Mikovits left her lab and the WPI building on September 29, at 3:30 p.m. after she had secured the notebooks in her desk. She informed her research associate she would be gone the next and the weekend, and placed keys to her office and the desk as was her habit, in the lab, so that appropriate lab members could access her materials at all times. While waiting for a research associate to pick her up so she could pick up her car rental to drive home in, Dr. Mikovits was outside of her residence on Sierra St in Reno, she received a call from Annette Whittemore. Mrs. Whittemore made an unreasonable and unethical demand that Dr. Mikovits give Dr. Lombardi a cell line paid for by her R01 NIH grant funding. Dr. Mikovits explained to Mrs. Whittemore that she could not allow that to happen, as she was constrained by her obligations, ethics, integrity and lawful obligations as a Principal Investigator. Mrs. Whittemore then screamed at Dr. Mikovits that (explicative deleted) she was fired.

    Dr. Mikovits never returned to the lab or her office after being informed she was terminated. Dr. Mikovits was not and is not in possession of the lab notebooks or any WPI intellectual property. A number of individuals have keys to the office and lab, including the administrative staff, lab staff and custodial. Your client’s concern as to the location of those notebooks, and intellectual property, should be directed elsewhere.

    Dr. Mikovits brought her thirty-year reputation of honesty, integrity, and laboratory research skills to WPI. This was to the direct benefit not only of the sufferers of ME/CFS, but WPI as an institute. Dr. Mikovits is the Principal Investigator (PI) on multiple government research grants, and those notebooks contain important non-proprietary information that was obtained in the course of said government-funded projects. The original data (gel photographs, charts, etc.) in the notebooks is important backup information for published papers and is needed for completion of publications funded by NIH, DOD and several corporate contactors. Data already published in scientific journals certainly does not constitute proprietary information. Dr. Mikovits’ notebooks, as well as those of the employees whom she supervised, should be returned to Dr. Mikovits so she can fulfill her responsibilities as PI on these government grants and corporate contacts, as there is an expectation on the part of the granting agencies that the results from government-funded research will be disseminated to the scientific community and to the public. Other than private medical information that is not to be disclosed to individuals who are not authorized by an approved IRB protocol, there is no “confidential, proprietary, and trade secret information” in the notebooks. Instead, there is important data that should be published to advance the field of neuroimmune disease. Failure of WPI to make these notebooks and raw data available to Dr. Mikovits so that she can fulfill her obligations and defend against false accusations of fraud will constitute serious harm to her reputation and scientific career. Dr. Mikovits has attracted a number of high quality scientific collaborators for the WPI and for the ME/CFS field. Her reputation for scientific excellence undoubtedly was an integral factor in the formation of these collaborations and in her being awarded a number of government grants as PI.

Unfortunately, those phrases could be used to describe the sudden wrongful termination of an individual whose direct efforts, and her well-deserved and hard-earned reputation for honesty and integrity, brought in over $3,000,000.00 for research at WPI. Moreover, Dr. Mikovits brought worldwide recognition and awareness of WPI and the victims of a devastating disease, ME/CFS, which continues to change the outlook and scientific research around the world. In particular, it is inappropriate and unethical for the WPI to prevent Dr. Mikovits from transferring to another institution the grants she obtained as PI, making it impossible for her complete the projects. This is especially so, in light of recent public statements that Mrs. Whittemore has made that WPI is no longer pursing such research at WPI.

    fully supported her travel costs. Dr. Mikovits gave herself over fully to this mission, donating not only her time, but also in giving back portions of her own earnings to WPI.

    Dr. Mikovits cannot sign the Termination Agreement because she is not in possession of her notebooks, flash drives, nor her laptop computer, which were taken when her office and lab was in control of the WPI.

    Dr. Mikovits is not intimidated by threats of lawsuit; rather she respectfully requests that the WPI honor all of its contractual and intellectual obligations to her as she has faithfully honored hers.

I was a huge fan of Dr. Mikovits until she opened her mouth. She needed to keep it closed.     The BWG used one method of XMRV detection, and the WPI had five methods.

    The BWG accidently used the least reliable method (PCR) to detect XMRV and refused to allow culture/antibodies due to 'time and cost'.

    The method the BWG forced the WPI to use did not use a stabilising chemical, rendering the results useless as the virus would degrade further.

    The BWG results were meaningless as they had a cohort of 15 people only.

    The evidence from Mikovits and Ruscetti will remain robust and relevant. They only studies that can change that are studies that replicate or use clinically validated assays.

    ViPDx under Lombardi did the blood working group. And as Annette Whittemore said on Facebook "It is important to note that the results reported in the blood working were not based on the testing methods that are used in the clinical laboratory."
    Controls in that study could not have been declared negative as PBMCs were not screened.

    I think she is motivated by financial interests and, unfortunately, greed. I am sure it costs a fortune to keep WPI up and running, with staff, high-tech equipment, mortgage or rent, and every other expense. This is a huge financial obligation.

    It all has to be paid for somehow. And research was their ticket. And the XMRV viral supposition did not pan out at WPI in their lab. (Whether or not a retroviral or other viral cause will be found in the future I have no idea.)

    Whittemore has to figure out how to keep WPI going. That her institution is also tied to a private lab that charged a lot for blood tests (a lot!), some of which may have been unethical — and the costs sounded unethical is suspicious.

    When scientific research is tied to profit-making, rather than done in a lab with no strings attached, where it's academic and free of the financial basic, to me it's a big contradiction.

    I have no idea what will happen. I hope that Dr. Mikovits has her day in court and can explain her side fairly.

    It is unethical to me to spend patients' and their families' and friends' donations on suing Dr. Mikovits. The donations were to be used for research and I'd guess treatment. They were given with good intentions.

    Whether or not XMRV or retroviruses turn out to be the cause or not, this is still unethical and profit-driven behavior on the part of WPI.

    I think Annette Whittemore knows what she is doing.

    I have always been suspicious of WPI since I read an article questioning Mr. Whittemore's financial wheeling and dealing.

    I don't trust them or their motives, notwithstanding their daughter's illness, with which I sympathize.

    And now Dr. Mikovits has to spend money on her legal defense and waste time on this, instead of doing research at another institution.

    Hopefully, we'll find out the truth in court, and Dr. Mikovits can be vindicated.

    P.S. How can you know that the WPI are using donated funds for the legal battle?

    Most of the information that comes out about Judy's interactions is heavily edited media content that has sought to paint her in a certain light for a long time.

    Burning eyes, Joan of Arc references aside. I think the confusion you might wish to attribute to Judy has little to do with her.

    I wonder how many times she has actually been quoted in context – which is why some may notice, these days she says as little as possible.

    Astroturf is not going to remove support for Judy over night. There's an inherent risk in supporting anyone that your trust may be misplaced, it doesn't make one foolish to place trust in a person.

    Especially a person who has so publicly put her career on the line.

    As people are suffering and dying from the same disease she has been treated for she should tell everyone what it is or she should no longer receive that treatment herself.

    Certain results? Lombardi at ViPDx conducted the BWG. The slides issue is over as Science and the reviewer knew about the slide. They saw it during the review. The other claim about needing controls on the same gel is also stupid as the study was blinded. Catch up will you.

    The fact is that Mikovits has done nothing wrong. And it is up to others to provide evidence if they want to make accusations. The same issue is there for HGRVs and the need for a replication study. Nope, everyone avoiding this. Why?

    Last year I donated money to the WPI, they probably didn't think that it was much but I tithed. Now I find out that my money is being used to pay lawyers to sue Dr. Mikovits. The rest of the CFS nation must share my grief and indignation.

    We must not support the WPI in anyway, monetarily, by giving blood samples or by seeking treatment at the WPI until Annette Whittemore withdraws this dreadful suit. I had resigned from the WPI when Dr.Mikovits was fired. I understand that my name is still on the WPI site and I am asking that it be removed.

    I have no idea what happened to the notebooks and other materials that Ms. Whittemore says is missing. My understanding is that Dr. Mikovits was locked out of her lab and when she was able to contact her laboratory associate, she was told that all was gone. I am glad that the police have been notified just in case the disappearance of the data is more nefarious than it appears on the surface.

    I demand that the notebooks and all other materials be returned to Dr. Mikovits immediately so that she can complete the important work that she is doing for us. Frankly, the WPI has no use for the notebooks and other materials as Dr.Lombardi is a protein chemist and not trained in immunology or retrovirology.

    I still have hope that Ms. Whittemore will reverse her legal actions and that Dr. Mikovits will get back her data and whatever else she needs. The WPI should pursue research that Dr. Lombardi is qualified for, such as proteomics. Then, perhaps we can support the WPI again but not till then.

    Who are you then? Come on be brave and tell us what you would never actually say? How were people duped? Without replication or clinically validated assays there is no scientific argument. The viruses are not XMRV/VP62, so we need to fully sequence them. All the negative papers looked for the wrong virus and didn't clinically validate.

    We've been had. Instead of a Nigerian Prince scheme, we've been taken in by a fat cat and country club queen under the guise of helping us all. Their daughter is doing better and the rest of us can continue to rot in hell. (but please keep those donations coming, folks!)

    Annette Whittemore is in way over her head, and gender has nothing to do with it. If the Whittemore's sincerely cared about advancing the science and patient care, she would appoint herself an honorary title to continue to fund raise and hire someone *qualified* and experienced to run a scientific and patient care institute. Anyone with an iota of sense knows this to be true.

    When Dr Peterson left, that waved a red flag for me. Who walks away from a spanking new building with their name on the side? No matter what his agenda, it spoke volumes about what must be going (or not going) on there. But I still wanted to believe the Whittemore's were in it for the greater good, and Dr Mikovits was going to be the one leading the charge.

    Hollywood should come calling any day, this is so twisted and wrong. Maybe good will prevail and our heroine will be code named Deep Sequence instead of Deep Throat.

Dr. Mikovits has not just duped the patients , she's duped *everyone* including the Whittemore Peterson Institute. It will all cone out in court. It would be do much better for her to come clean before she is in contempt of court.
